Terms of delivery for orders from foreign countries
(dated February 09, 2004)

General Terms
These Terms of Delivery are valid for all customers outside of Germany and their orders placed at Colosseum Schallplatten and at Colosseum's Online Shops according to Colosseum''s offer in this Web-Site. The Terms of Delivery are also valid should the order contain goods that are not offered in this Web-Site.

Security for our Online Shops
The connection of our Online Shops for the Varèse Sarabande CD Club CDs and our Online Shop for Mino – Music For Kids products are secured by our secure server software (SSL). SSL encrypts all of your personal information, including credit card number and your name and your e-mail address, so that it cannot be read as the information travels over the Internet.

Privacy
All information you provide us with will be treated as confidential and not passed on to other sources.

Prices
All prices are in EURO and are subject to change. Colosseum attempts to make all information accurate and current but typing mistakes may occur. Should this be the case you will be notified of the correct prices upon receipt of order. Only the prices billed in our invoices are then valid.

Delivery
The goods will be shipped ex works Nürnberg at the customer''s risk and will remain the entire property of Colosseum until paid for (§ 455 BGB). Unless otherwise requested we ship by post surface mail. Any damage on the packaging or damaged CD-Boxes should be reported immediately to the forwarder. We will not be responsible for any loss of goods during transportation.

Customs duty and foreign taxes
The customer is responsible for any costs involved with customs clearing, import duties, import taxes or any additional shipping charges or costs that appear in his country and/or in the country he wants to have the goods shipped to.

Shipping charges
All shipping charges are to be paid by the customer and will be billed separately with the ordered goods. For details and costs please check our Ordering Information. Details concerning shipping charges to countries outside of Europe can be quoted upon request.

Delivery Time
The delivery time ex works Nürnberg to Europe is approximately 3-5 days after receiving the order or by payment in advance 3-5 days after receipt of the payment.

Payment
For orders from European Countries and from countries outside of Europe we accept payment by credit card (Visa, MasterCard, Access and Eurocard). Customers from European countries can also pay in advance by bank cheque drawn on an International Bank in Germany and payable in EURO as well as an International Money Order in EURO payable to our account at Post Bank. For more details please look at our Ordering Information. Please do not forget to include your name and address and our reservation or confirmation number on your payment. More details concerning methods of payments for Non-European countries can be quoted upon request.

Acceptance of shipment
Should you refuse the acceptance of the shipment or not pick up the shipment at your local post office or customs office we will only ship these goods a second time upon your request. However, we will then have to charge you for the additional shipping costs as well.

Warranty
Only goods which are faulty due to productional defects can be returned for exchange. The time limit for these reclamations is 8 days after receipt of the shipment. Please contact us beforehand to obtain an official clearance number for the outside of the package. All shipments being returned to us must have our official clearance number on the outside and should be sent by post, Federal Express, UPS or the like and should be shipped franco domicile Colosseum. In case of substantial reclamations we will exchange the product but we will not be responsible for any material or nonmaterial losses or damage. The product cannot be returned or exchanged in the case that it does not match the customer\'s expectation in taste or anything similar.

Cancelling an item:
Under the German Distance Selling Regulations, you have the right to cancel the contract for the purchase of any item within fourteen working days of delivery. This applies to all our products. However, we regret that we cannot accept cancellations of contracts for the purchase of any CDs, MCs, LPs, books or videos which have been unsealed.

To cancel a contract, please package the relevant item(s) securely and send it (them) to us with the delivery slip so that we receive it within fourteen working days of the date that the item was delivered to you and mark this package with the wording "Contract cancellation". Once again, please be aware that we cannot accept cancellations of contracts for the purchase of CDs, MCs, LPs, books or videos if the item was opened and/or when the item has been unsealed.

Miscellaneous Terms
Any verbal or other agreements will only be valid after our written confirmation.

Local venue
All deliveries shall be construed and governed by the laws of Germany. The Court of Nürnberg shall be the courts of jurisdiction.
